Terms of Service

These terms are an agreement between you and Cloudstackers LLC, a Maryland limited liability company ("we"), about Helpings at helpings.app. You accept them when you tap "I agree" in the app. Our Privacy Policy and Consumer Health Data Privacy Policy explain how we handle your information.

1. Who can use Helpings

• You must be 18 or older, and new accounts can be opened only in the United States (the 50 states and DC).
• One account per person. Keep your email secure: anyone who can read it can sign in as you.

2. Not medical advice

Calorie estimates come from an AI model and can be wrong, sometimes by a lot. A calculated goal uses a standard formula that knows nothing about your health. Helpings doesn't diagnose or treat anything and isn't a substitute for a doctor or dietitian. If you're pregnant, have a medical condition or have had an eating disorder, talk to a doctor before changing what you eat.

3. Subscription and trial

• $5 a month or $45 a year in US dollars, plus any sales tax. Payments go through Stripe.
• The 7-day free trial needs a card. Unless you cancel before it ends, your subscription starts and you're charged. One trial per person.
• Your subscription renews automatically each month or year until you cancel. We email you 30 days before an annual plan renews, and 30 days before a price change takes effect.
• If a payment fails, AI estimates keep working for 7 days, then pause until it goes through.
• Without a subscription, everything except AI estimates keeps working.

4. Cancelling and refunds

• Cancel any time in Settings → Cancel subscription, or by emailing us. AI estimates keep working until the end of the period you've paid for.
• Payments aren't refunded, including for part of a period, except where the law requires. If we close your account without cause or shut Helpings down, we refund the unused part of your paid period.

5. The AI allowance

Each subscription includes a monthly allowance of AI estimates. Settings shows how much you've used and when it resets, and when it runs out, new estimates and Adjust pause until then. There's also a daily limit per account. We may change the allowance, with 30 days' notice before making it smaller.

6. Your content

What you put in Helpings is yours. You let us store and process it, and send it to our AI providers, only to run and improve Helpings as our Privacy Policy describes. Only upload photos you have the right to use.

7. Acceptable use

Use the AI only to log food: don't try to get around its instructions. No automated or bulk use, no getting around the allowance or limits, no illegal content, no attacks on Helpings or on other people's data, and no reselling Helpings. What you send to the AI is also subject to Google's Generative AI Prohibited Use Policy.

8. Ending your account

You can delete your account at any time in Settings. We may suspend or close an account that breaks these terms or doesn't pay, and we'll tell you first when we reasonably can. If we shut Helpings down, we'll give you 30 days' notice so you can download your data.

9. Disclaimers and liability

To the extent the law allows, Helpings is provided "as is" without warranties, and we aren't liable for indirect or consequential damages or lost data. Our total liability is limited to the greater of what you paid us in the past 12 months and $50.

10. Disputes

Maryland law governs these terms. Disputes go to the state courts in Montgomery County, Maryland, or the federal courts for the District of Maryland, though either of us may use small claims court. Please email us first so we can try to sort it out. This doesn't take away consumer rights you have where you live.

11. Changes and the rest

We may change Helpings and these terms. We email you before a material change to these terms takes effect; if you keep using Helpings after that, the new terms apply. If a change removes something a paid plan includes, we tell you ahead of time so you can cancel. These terms and the two policies are the whole agreement. If part can't be enforced, the rest still applies. We send notices to your account's email address.
